SMS Terms and Conditions

These SMS Terms and Conditions (“SMS Terms”) describe how ScaleYourJunk LLC and businesses using the ScaleYourJunk platform (“Operators”) send text messages (SMS/MMS) to end consumers (“you” or “your”) through the Platform. These SMS Terms supplement our Terms of Service and Privacy Policy.

1. SMS Messaging Program Description

ScaleYourJunk is a software platform used by junk removal and dumpster rental businesses to manage their operations. As part of the Platform, SMS messages are sent to consumers on behalf of these businesses for the following purposes:

  • Appointment confirmations — Confirming a booked junk removal or dumpster rental appointment
  • Appointment reminders — Day-before reminders for upcoming appointments
  • Crew notifications — Notifying you when a crew is en route to your location
  • Job completion notifications — Confirming that a job has been completed
  • Invoice and payment notifications — Sending invoice links and payment reminders
  • Review requests — Requesting a Google review after service completion
  • Follow-up messages — Following up on inquiries or quotes that have not yet been booked
  • Dumpster rental updates — Notifications related to dumpster delivery, swap, or pickup status
  • Customer portal links — Sending links to view job status, track your crew, or access your customer portal
  • General operational communications — Any other transactional messages related to a service you have requested or an inquiry you have made

Messages are sent from phone numbers provisioned through the ScaleYourJunk platform. The sending phone number will be the business number of the junk removal or dumpster rental company you are doing business with.


2. Consent and Opt-In

You may be enrolled in our SMS messaging program through one or more of the following methods:

2.1 Online Booking

When you book an appointment through an Operator's website powered by ScaleYourJunk, you enter your phone number and check a consent checkbox that states:

“I agree to receive text message updates about my appointment, including confirmations, crew notifications, and invoices. Message and data rates may apply. Reply STOP to opt out at any time.”

2.2 Phone Booking

When you call a business and an appointment is scheduled (either by a human operator or by an AI phone agent), the operator or agent confirms:

“We'll send you a text confirmation to this number. Is that okay?”

Your verbal consent is logged in the system.

2.3 Manual Entry / Contact Form

When you submit your phone number through a contact form or an Operator manually creates a record with your phone number, the first SMS sent to you will include opt-in language:

“Hi, [Company Name] has scheduled your junk removal. You will receive appointment updates via text. Reply STOP to opt out at any time. Msg & data rates may apply.”

2.4 Customer Portal

When you provide your phone number through the customer portal for the purpose of receiving service updates, you consent to receiving related SMS notifications.

By providing your phone number and consenting through any of the above methods, you expressly agree to receive the SMS messages described in Section 1.


3. Message Frequency

Message frequency varies based on your interactions with the Operator:

  • For a typical junk removal appointment, you may receive 2-5 messages (booking confirmation, reminder, crew en route, completion, review request)
  • For a dumpster rental, you may receive 3-8 messages depending on the rental duration and number of swaps
  • Follow-up messages for unbooked inquiries are limited to a reasonable number over a defined period
  • Payment reminder messages are sent no more than once per day per outstanding invoice

Message frequency is not recurring on an ongoing basis — messages are tied to specific service events and interactions.


4. Message and Data Rates

Message and data rates may apply.

Standard messaging rates from your wireless carrier apply to all SMS messages sent and received. ScaleYourJunk and the Operators do not charge separately for SMS messages, but your carrier may charge you per message or as part of your mobile plan.


5. Opt-Out / How to Stop Messages

You may opt out of receiving SMS messages at any time by:

5.1 Replying STOP

Reply STOP to any message received from the Operator's phone number. You will receive a final confirmation message:

“You've been unsubscribed from [Company Name] text messages. You will no longer receive SMS updates. Reply START to re-subscribe.”

After opting out, no further messages will be sent to your number from that Operator's phone number.

5.2 Contacting the Operator

You may contact the junk removal or dumpster rental business directly and request to be removed from SMS communications.

5.3 Contacting ScaleYourJunk

You may email us at support@scaleyourjunk.com with the subject line “SMS Opt-Out” and include the phone number you wish to unsubscribe.

Opting out of SMS does not cancel your appointment or affect the services you have booked. You will still receive service via email or phone if applicable.


6. Help

For help or questions about SMS messages, you may:

  • Reply HELP to any message to receive support information
  • Contact the Operator directly using the phone number from which you received the message
  • Email ScaleYourJunk at support@scaleyourjunk.com
  • Call ScaleYourJunk at (832) 235-3996

When you reply HELP, you will receive:

“For help, contact [Company Name] at [Operator Phone]. Msg & data rates may apply. Reply STOP to opt out.”

7. Supported Carriers

SMS messages are sent via major wireless carriers in the United States, including but not limited to AT&T, Verizon, T-Mobile, Sprint, U.S. Cellular, and their respective MVNOs (Mobile Virtual Network Operators). Carriers are not liable for delayed or undelivered messages.


8. Privacy and Data Use

8.1 Phone Number Usage

Your phone number is used solely for the purposes described in Section 1 (operational and transactional SMS communications related to services you have requested or inquired about).

8.2 No Sale of Phone Numbers

We do not sell, rent, or share your phone number or SMS opt-in data with third parties for marketing or promotional purposes.

8.3 Data Sharing

Your phone number and message data may be shared with:

  • The Operator — the junk removal or dumpster rental business you are doing business with, for the purpose of service delivery and customer communication
  • Twilio — our SMS delivery provider, for the sole purpose of transmitting messages
  • Law enforcement or government authorities — when required by law or legal process

8.4 Data Retention

Your phone number and message history are retained in the Operator's account for the duration of their subscription. If the Operator cancels their ScaleYourJunk subscription, your data is deleted within 30 days. If you opt out via STOP, your number is immediately added to a suppression list to prevent future messages — this suppression record is retained to ensure we honor your opt-out. 9. Disclaimer

SMS messaging is provided as a convenience for transactional and operational communications. ScaleYourJunk and the Operators are not liable for:

  • Messages that are delayed, lost, or not delivered due to carrier issues, network congestion, or device incompatibility
  • Charges incurred by your wireless carrier for receiving messages
  • Any errors in message content caused by inaccurate information provided by the Operator or by the AI Phone Agent

SMS messages should not be relied upon as the sole means of communication for time-sensitive or emergency matters. If you need immediate assistance, please call the Operator directly.


10. TCPA Compliance

ScaleYourJunk and the Operators are committed to compliance with the Telephone Consumer Protection Act (TCPA) and all applicable federal and state regulations governing SMS communications. Messages are only sent to individuals who have provided prior express consent as described in Section 2. All messages include opt-out instructions.


11. Changes to These SMS Terms

We may update these SMS Terms from time to time. Changes will be posted on this page with an updated “Last Updated” date. Material changes affecting your rights will be communicated via the Platform or email. Your continued receipt of SMS messages after changes are posted constitutes your acceptance of the updated SMS Terms.
